บทคัดย่อ (Abstract):

การสอบสวนเป็นขั้นตอนที่สำคัญของการดำเนินกระบวนการยุติธรรมทางอาญา และเป็นเงื่อนไขในการฟ้องคดีของพนักงานอัยการ การสอบสวนคดีอาญาของพนักงานสอบสวนจึงมีผลต่อการอำนวยความยุติธรรมทางอาญาเป็นอย่างมาก หากการสอบสวนกระทำด้วยความถูกต้อง รวดเร็วและเป็นธรรมตามบทบัญญัติแล้ว ย่อมก่อให้เกิดประโยชน์และผลดีต่อการอำนวยความยุติธรรมทางอาญาในภาพรวมแต่จากการศึกษาพบว่ามีปัญหาและอุปสรรคข้อขัดข้องหลายประการทั้งปัญหาทางด้านกฎหมายและปัญหาทางด้านอื่น ๆ ที่ทำให้การสอบสวนไม่เป็นไปตามบทบัญญัติดังกล่าว
	 กรณีการสอบสวนที่ไม่ถูกต้อง ล่าช้าและไม่เป็นธรรม ปัญหาอาจเกิดจากการสอบสวนเองโดยลำพังของพนักงานสอบสวนเป็นเหตุให้ขาดการตรวจสอบและถ่วงดุลจากองค์กรอื่น การขาดการมีส่วนร่วมรวมทั้งการตรวจสอบการปฏิบัติงานของตำรวจจากภาคประชาชน และการสอบสวนรวบรวมพยานหลักฐานที่ไม่ครบถ้วนสมบูรณ์รวมไปถึงปัญหาค่าตอบแทนของพนักงานสอบสวนที่ไม่เหมาะสมกับภาระงาน
	 ดังนั้นเพื่อให้การสอบสวนมีประสิทธิภาพ ถูกต้องและรวดเร็ว ควรมีแนวทางในการแก้ไขปัญหาข้อขัดข้องดังกล่าวอันประกอบด้วยข้อเสนอแนะหลายประการ เช่น การกำหนดระเบียบหรือคำสั่งของสำนักงานตำรวจแห่งชาติที่วางแนวปฏิบัติให้พนักงานสอบสวนดำเนินการสอบสวนโดยถูกต้องรวดเร็วและเป็นธรรมมากยิ่งขึ้น การเข้าสู่ตำแหน่งพนักงานสอบสวนหรือตำแหน่งอื่น ๆ ของสำนักงานตำรวจแห่งชาติควรเป็นไปด้วยความโปร่งใสตามระบบคุณธรรม รวมถึงการกำหนดมาตรการในการส่งเสริมสิทธิสวัสดิการ และความเจริญก้าวหน้าในอาชีพราชการของพนักงานสอบสวน ทั้งนี้เพื่อจุดมุ่งหมายในการสอบสวนเป็นไปอย่างมีประสิทธิภาพ โปร่งใส ตรวจสอบได้อันจะทำให้การสอบสวนเป็นมาตรการทางกฎหมายที่ช่วยอำนวยความยุติธรรมให้แก่ประชาชนและสร้างความเป็นธรรมให้แก่สังคมสืบไป

The judicial investigation is a critical phase of the criminal justice system. The persons suspected then are under a condition to be taken into the prosecution process in court. The investigation can have a significant impact on the administration of justice. Overall, investigation procedures that are fairly and properly conducted and carried out in accordance with the relevant regulations will benefit the proper delivery of justice on the whole. However, the study reveals a number of overriding obstacles that become main barriers to the standard operating procedure for crime investigation. The nature of the dispute investigation process may occur from these following factors: the relevant officers working alone; the entire process is carried out without checks and balances by other institutions; absence of participatory monitoring of officials’ performance of their duties from the public sector commission; partial or incomplete evidence; and compensation unsuited for service in the field. Guidelines and recommendations to address the issues are as follows: firstly, the Royal Thai Police Headquarters should establish the Investigation Procedure Manual to serve as guidelines to assist related officers. Secondly, the merit-based principle and transparency measures should be applied for the recruitment of qualified candidates for investigation officer positions. Finally, measures to support increased welfare and career progression are recommended. Such implementation will promote official morale, ensuring that the judicial integrity alongside effective,
fair and transparent investigation procedures will be enhanced at all times.
